§ 1. General

The privacy policy and the use of cookies on the https://opennano.pl/ website (hereinafter: „Policy”) was created and adopted by opeNnano Polska sp z o.o. 32-020 Wieliczka ul. Grottgera 58
The terms used in the Policy mean:
Website: https://opennano.pl website;
User: an entity using a publicly available Service;
Owner: opeNnano Polska sp z o.o.,Wieliczka, 32-020, ul. Grottgera 58 NIP 6832067319, REGON:121486295, KRS:0000381591, BDO 000054305
Cookies: text files sent by the Website and stored on the User’s end device, which he uses when browsing websites.The files contain information necessary for the proper functioning of the Website.Cookies most often contain the domain name of the website from which they originate, the time of their storage on the end device and the number;
The purpose of the Policy is in particular:
to provide users with information on the use of Cookies on the Website, in accordance with the requirements of law, including telecommunications law;
provide users with privacy protection to the extent that they meet the standards and requirements set out in applicable law.
The Owner limits the collection and use of information about Users to the minimum necessary to provide services to them.
In order to gain full access through the Website to the content and services offered by the Owner, it is advisable to accept the rules resulting from the Policy.
The following provisions of law shall apply m.in:
the Telecommunications Law Act of 16 July 2004 (Dz. U. 2017.1907, i.e. as amended);
Act of 18 July 2002 on the provision of electronic services (Dz. U. 2017.1219 i.e. as amended);
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L …, p. L 119 of 4.5.2016) together with Polish regulations on the protection of personal data.

§ 2. Protection of privacy and personal data

Data concerning Users are processed by the Owner in accordance with the law. The Users’ personal data obtained by the Owner are processed on the basis of the consent granted by the User or the occurrence of another condition entitling to process data in accordance with the regulations, in particular the Regulation.
The Owner takes special care to protect the interests of data subjects, and in particular ensures that these data are:
processed in accordance with the law, fairly and transparently for Customers and other data subjects;
collected for specific, explicit and legitimate purposes and not further processed in a manner inconsistent with those purposes;
adequate, relevant and limited to what is necessary for the purposes for which they are processed;
correct and, where necessary, kept up to date;
kept in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the data are processed;
processed in a way that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and accidental loss, destruction or damage, by means of appropriate technical or organizational measures, the Owner applies appropriate technical and organizational measures
to ensure the protection of the processed personal data appropriate to the nature, scope, context and purposes of processing and the risk of violation of rights or freedom of natural persons.
The Owner strives to systematically modernize the applied IT, technical and organizational measures to protect this data, in particular the Owner provides updates of IT protection measures allowing for protection against viruses, unauthorized access and other threats resulting from the functioning of the IT system and telecommunications networks.
Each User who has made their data available to the Owner in any way the Owner provides access to data and the use of other rights to data subjects, in accordance with the applicable law, including these persons have:
the right to withdraw consent to the processing of personal data;
the right to information about their personal data;
the right to control the processing of data, including their supplementation, updating, rectification, deletion;
the right to object to processing or to restrict processing;
the right to lodge a complaint with a supervisory authority and to use other legal remedies to protect your rights.
The Owner may process personal data in an automated manner, including through profiling, on the terms resulting from the Regulation. In this case, the purpose of the Owner’s activities are marketing purposes or the need to personalize messages sent to Users (including matching information to the needs or expectations of the User). The User has the right to object to such processing of his data – this objection may be expressed by sending a message to the Owner’s address: bok@opennano.pl.
A person with access to personal data processes them only on the basis of the Owner’s authorization or a contract for entrusting the processing of personal data and only at the request of the Owner.

§ 3. Media

Suggested text: If you are a registered user and upload images to your site, you should avoid uploading images with location EXIF tags. Website visitors can download and read full location data from images on the site.

§ 4. Cookies

Cookies identify the User, which allows us to adjust the content of the website he uses to his needs. By remembering his preferences, he allows you to properly match the content addressed to him, including advertisements. The Owner uses Cookies to guarantee an appropriate standard of convenience of the Website, and the collected data is used only within the company to optimize operations.
Cookies are used in order to:
adapt the content of the Website to the User’s preferences;
optimization of the use of the Website, in particular by recognizing the User’s end device,
creating statistics,
maintaining the User’s session,
providing the User with advertising content.
Cookies may be placed on the Website User’s end device.
The collected data is used to monitor and check how Users use the Website in order to improve the functioning of the Website by providing more effective and trouble-free navigation.
Please note that in some cases, independent of the Owner, the software installed by the User on the end device used to browse websites (e.g. a web browser) introduces the default storage of Cookies on the User’s end device. Users can change the settings for Cookies at any time. These settings can be changed, among others, in such a way as to block the automatic setting of Cookies or inform about their each placement in the User’s end device. Detailed information in this respect is available in the settings and instructions for the software (web browser).
The User has the option of disabling or restoring the option of collecting Cookies at any time by changing the settings in the web browser.
Changing the settings is an expression of objection, which in the future may cause difficulties in using the Website. Completely disabling the option of accepting Cookies will not mean that it is impossible to view the content posted on the Website, subject to those to which access requires logging in.
Failure to change the settings means that the data will be placed on the User’s end device (using the Website will result in the automatic placement of Cookies on the User’s end device).
The stored data placed in the User’s end device do not cause configuration changes in the User’s end device or software installed in this device.
Information on Cookies also applies to other similar technologies used on the Website.

§ 5. Final provisions

The Policy was adopted by order of the Owner and enters into force on 25.05.2018. A change in the content of the Policy may take place in the same manner.
Any deviation from the Policy requires a written form under pain of nullity.
The law applicable to the Policy is the law of the Republic of Poland.
In matters not regulated in the Policy, the relevant provisions of law shall apply.
